Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and ARIA OS, operated by Anshul Raman ("we", "us", or "our"), governing your use of the ARIA OS desktop app, website, and related services (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

ARIA OS is a private AI desktop. It lets you chat with an assistant, run an agent (Forge) that performs tasks in your workspace, store memory and files, and connect your own AI model key and integrations. Features, plans, and limits may change over time as we improve the Service.

2. Eligibility and your account

You must be at least 13 years old (or the minimum age of digital consent in your country) and able to form a binding contract to use the Service. You are responsible for keeping your login credentials secure and for all activity under your account. Notify us promptly of any unauthorized use.

3. Plans, billing, and renewals

ARIA OS offers a free tier and paid subscription plans (such as Pro and Max). Paid plans are billed in advance on a recurring basis (for example, monthly) through our payment processor, Stripe.

  • Your subscription automatically renews at the end of each billing period until you cancel.
  • You can cancel at any time from Settings or the Stripe customer portal; your paid access continues until the end of the current billing period.
  • Prices may change; we will give reasonable notice before a change affects you, and changes apply to the next billing period.
  • You are responsible for any taxes that apply to your purchase.
  • Payment-card details are handled by Stripe; we do not store your full card number.

Refunds are governed by our Refund & Cancellation Policy.

4. Free tier and usage limits

The free tier includes a monthly allowance of messages and tool actions, and we may offer a higher allowance for your first month. Limits for each plan are described on our pricing page and enforced within the Service. We may adjust free-tier limits over time.

5. Bring your own key and third-party providers

ARIA OS runs on the AI model you choose. You are responsible for obtaining and paying for your own model provider account (for example, Anthropic, OpenAI, or OpenRouter) and for complying with that provider’s terms. Your subscription to ARIA OS pays for the product and experience, not for model tokens. We are not responsible for the availability, output, pricing, or actions of third-party providers or integrations you connect.

6. Acceptable use

You agree not to use the Service to:

  • Break the law or infringe anyone’s rights, including intellectual property or privacy rights.
  • Upload or generate malware, or attempt to gain unauthorized access to any system or data.
  • Harass, abuse, or harm others, or generate content that is illegal or that the Service is not intended to produce.
  • Reverse-engineer, resell, or misuse the Service except as permitted by law.
  • Place excessive load on the Service or interfere with its operation or security.

The Forge agent can take real actions (such as writing files and running commands) in environments you authorize. You are responsible for the permissions you grant and for reviewing the actions you run. Use autonomy on repositories and machines you trust.

7. Your content

You own the content you create with ARIA OS — your chats, memory, notes, files, and other materials ("Your Content"). You grant us a limited license to host, process, and transmit Your Content solely to operate and provide the Service to you (for example, to sync it across your devices and send requests to your chosen model provider). We do not use Your Content to train our own models, and we do not claim ownership of it.

8. Our intellectual property

The ARIA OS software, website, branding, and design are owned by us and protected by intellectual-property laws. These Terms do not grant you any right to our trademarks or to copy, modify, or distribute the Service except as expressly permitted.

9. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, to the fullest extent permitted by law. AI output may be inaccurate, incomplete, or unsuitable for your purpose; you are responsible for reviewing and verifying it before relying on it. We do not warrant that the Service will be uninterrupted, secure, or error-free.

10. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or revenue, arising from or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the event giving rise to the claim (or USD 100 if you have not paid us anything).

11. Indemnification

You agree to indemnify and hold us harmless from claims, damages, and expenses (including reasonable legal fees) arising from your use of the Service, Your Content, or your violation of these Terms or applicable law.

12. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or if necessary to protect the Service or other users. Provisions that by their nature should survive termination (such as ownership, disclaimers, and limitation of liability) will survive.

13. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you. Your continued use of the Service after changes take effect means you accept the updated Terms.

14. Governing law

These Terms are governed by the laws of the State of Ohio, United States, without regard to its conflict-of-laws rules. You agree that any dispute will be subject to the exclusive jurisdiction of the courts located there, unless applicable law requires otherwise.
